Choice of Law and Venue. These Terms of Use are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to its conflicts of laws principles. Each party to these Terms of Use submits to the exclusive jurisdiction of the state courts located in Fairfax County, Virginia or the federal courts having jurisdiction over Fairfax County, Virginia, and waives any jurisdictional, venue, or forum non conveniens objections to such courts with respect to any claim, dispute, action, or proceeding arising or relating to your use of the Website or these Terms of Use.

Arbitration. At Fluet’s sole discretion, it may require you to submit any disputes arising from these Terms of Use or use of the Website, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Virginia law.

Waiver and Severability. No waiver by Fluet of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Fluet to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. In the event that any of the Terms of Use are held by a court or other tribunal of competent jurisdiction to be unenforceable, those provisions shall be limited or eliminated to the minimum extent necessary so that these Terms of Use shall otherwise remain in full force and effect.

Entire Agreement. These Terms of Use, together with the Disclaimer, and the Privacy Policy, constitute the entire agreement between FLUET and you regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
